Victims' Survivors Sue Killer's Family
SANTA ANA, Calif. (AP) - Survivors of a father and daughter shot to death by a disturbed neighbor in a cape and helmet who later turned his gun on himself are suing the killer's family, the dealer who sold him the weapon and a support group.
Vernon Smith, 45, and his daughter Christina, 22, were killed on Oct. 29, 2005, when 19-year-old William Freund burst into their house with a 12-gauge shotgun, authorities said.
Vernon Smith's son Brandon, who escaped, and his wife Denise, who was at work during the shooting, filed suit this week in Orange County Superior Court seeking damages for wrongful death and emotional distress.
The lawsuit claims Freund's parents allowed their son to have a gun, failed to supervise him and failed to warn neighbors about his potentially violent personality.
The suit contains similar accusations about WrongPlanet.net, a Web site for people with Asperger's syndrome, a neurological disorder characterized by poor communication and social skills. Freund, who suffered from the disorder, left a message at the site saying he planned to "Start a Terror Campaign to hurt those that have hurt me."
Freund's parents and WrongPlanet founder Alexander Plank declined to comment. Plank said last year that moderators attempted but failed to contact Freund's parents.
George Hueneman, owner of Saddleback Valley Gun Center, said Freund's background check for purchasing a gun came up clean. "How am I supposed to know that he was a mentally disturbed teenager who was on prescription medication?"

From what I read, he didn't even really know her. I don't think anyone knows for sure why he chose her.

Maybe he had admired her from a distance and got some idea that he had been trying to get her attention and that she had turned him down. Maybe he was pissed off for her going to someone he thought didn't deserve her.

Ugh. I feel a vague hope that WP loses, not enough to bankrupt alex for life but something to bring some peace to the victims' family. Honestly it's too painful to think about in terms of putting myself in thier place to be sure, but I hope they find some peace.

Although I am disgusted with Alex for trying profit off the incident I'm equally disgusted that WP is being singled out while other forums the kid was posting on aren't being targeted at all. Actually I'd be just as disgusted if any forum the kid was a member of were targeted in the suit.
He did what he did and he alone should be held responsible for his own actions. Period.

If William Freund didn't make specific threats to those persons, whom he actually later turned out to kill, there can be no blame on WP. Absolutely ridiculous. A message board isn't some kind of police squad.

I can understand why robert and ascan want to think good of alex. They see him as bullied and most of his "mistakes" are caused by that. But they are seeing what they want to see. I'd love to support alex even though he is a selfish brat, but he is an incompetant selfish brat. The reason why alex will continue to make "mistakes" in the future is because they aren't mistakes, they are the times he gets caught. He's a sociopath, which doesn't make him evil, but it does make him selfish and impulsive, and shit like this will happen. And I think both ascan and robert and a ton of people on here really don't see that. It is possible to coexist with alex, but you largely cannot trust him, and you shouldnt build a relationship with him that relies on trust, because he is likely to use you.

Maybe this lawsuit will start to establish precedents in that area, regarding public message boards. I'm no legal mind, but I don't know of another case like this one. I can't imagine how they can create a scenario where WP has some culpability in a member's actions.
Many people blast venom around them and threaten others as a stress outlet. How many other potential criminals are lurking in the membersip at various fora? We can't know this for certain. How do you recognize if a person is at the brink of violence. WP has no responsibility in this case, especially if they can prove they were trying to contact people to stop a crime.
Alex will come out smelling like a rose, I predict.

whenever i am in doubt about the logic of a situation i try to follow the money. that usually leads me to the right premise of the logic.

This is one thing about the US that I don't like. I'm pretty neutral in the conflict I2 vs WP, actually, Alex and I changed PMs when I was new to WP and to me he seemed nice. However, I have no reason to doubt what you say about this with getting attention out of the tragedy, because that is just too much to make up, even if you hate someone. But on the same time, WP is no police and can't be held responsible for anything of this. It shouldn't even be possible in any way to drag WP into a lawsuit because of this. If it is, it's something very wrong with your legal system.

I know. :( In my country it's the other way around. It's very hard to successfully sue anyone, not even the guilty ones, and you won't get much money out of it either.

I don't think he is an asshole. I just think that if he is presented an opportunity to benefit himself without damaging his image, he will act on it, without regard to the ethical or moral considerations. It is just sometimes he makes a mistake on what will damage his image or not. I don't think people should be hated for biological conditions beyond their control.

Does anyone remember who were the ones who tried to contact the family? It wasn't before my time, but I was dealing with some Ghosthunter-related crisis at the time, I think - so I was offline for a day or two and when I came back it was all over.

Agreed, and what disturbs me is that WP is being singled out because it's a spectrum site. The last thing we need is Asperger's being linked closer to violence in the public eye.

He's not incompetent, and that's why WP still exists. He's just cunning enough to stop pissing people off when it's about to cause him some serious damage. In his blindness he outlasts both the people who intend to change/help him and the people who intend to cause him harm.

It depends on what your goals are. If your goals contradict his, and he is in a position of power, then it is not possible to co-exist with him. Not for me anyway - it's possible that someone else might be better at manipulating him. But believe me, I tried. And it turned out to be a major waste of energy, because though I could change things, and get my way, it was to such a small degree, and the changes were happening so slowly, that the energy would be better spent elsewhere. I never trusted him, and knew what I was walking into, and didn't really give a damn if he "used" me because I don't believe that there's anything unusual or wrong about being used (everyone uses anyone they interact with).

Interesting observations Pyraxis, it does help me make sense out of all the stuff thats been vented out of different people over the last year! But, I don't think this is going to be any more damaging to Asperger's image than anything else that has arisen. I can't pinpoint the reason why I feel that way, but, IMO, the facts of the crime that he committed are going to overwhelm any link to Asperger's. Thats just a media frenzy concoction! Throw enough shit in a blender, with other stuff like asperger's and what comes out will still taste like shit. Asperger's/autism info will fall by the wayside as it becomes more apparent that this douche bag was just a plain old psycho!

The psych who dx'ed me with Asperger's mentioned in his report that my affect is
"odd and stilted, almost schizoid-like." Sadly, neither Asperger's nor schizoid
personality disorder "exists" anymore. So I am without a diagnostic country, in a sense. :nerdy:

The public mental health system I accessed in 2014 said in my discharge summary that they were able to treat my depression (which they did, credit to them) but not my schizoid PD because it would take too long! I found that funny. I don't think they acknowledged autism. So they were still going by the DSM-IV.

Have read a number of adults autistics have been previously misdiagnosed as schizoid. It's easy to see how some of the criteria are similar and at the same time very different. One of the main differences in the aspect of personal relationships is schizoids have a lack of interest in relationships, while autistics do want relationships but are inept in acquiring/sustaining them. Have wondered if some adults are misdiagnosed because they can appear avoidant, when maybe over time they've stopped trying.

i did not. at the time i was under siege at my job so i wasn't reading the site much and decided to ignore it so i didn't have to pay attention to responses.
that would have been a good question because it appeared that they knew about it before i did.

"Pig" was a non-conformists' name for a member or especially a representative of "The Establishment" during the sixties. As time passed, the most evident of those representatives were the ones who took us to jail for gathering peacefully in protest of various causes. In other words, the police were called "pigs." That definition has stuck fairly well over the years.
Many "purists" still use the older meaning; anyone bought and sold to make a buck or two AND by doing so, supported the "Establishment" which was in question way back then, much as it still is to this day. (I had to go to the pigs - bankers - when I refinanced my house a few years ago to take advantage of the extremely low interest rates. I might be a pig?!? :hide:) The definition of "establishment" has evolved over the years, but I can still call "PIG" when I see it.

I think the implication is supposed to be that the shirt wearer is propositioning people s/he wants to "eat" and asking first if they are gluten free?
Also as someone with celiac I find the whole thing offensive and I am traumatized and upset that there was no trigger warning.

I have not been there, but you know what I think of the entire idea of Britannia related stuff in general. I have made it clear; if I am pursuing prejudice, it is those who formed many of the failures my own country has to live with which we had to fight over a number of times to just get the "crown's influence" out of our land.
If I had my choice, I would go for Seattle or about fifty miles outside or about fifty miles outside Denver, assuming I was not able to "go back home" and create a fabulous place in the southern parts of Texas, near a river I can fish in and on the weekend go to the coast and fish in the sea.
I miss fishing where you can eat your catch. Indiana is not safe to eat, in my book. Too much industry pollution over more than a century of neglect.
(I did not know any of this when I moved here to marry the woman of my dreams)

I lived just outside London for about 2 years. Part of that time in beautiful Basildon, Essex. And part of that time in Aylesbury, Buckinghamshire.
I like London and England in general, but I wasn't all that happy when I lived there. But on the upside it did kind start the ball rolling for 13 years of travelling and living in all sorts of far-flung places for work and I kind of went from a recluse to a semi-functional human being in that time. I don't know what would have happened to me if I'd taken the safer path and stayed in Sydney.
My favourite thing in London, by far, is the British Museum. And my favourite day trip out of London is the Imperial Air Museum (or whatever it is called) at Duxford. I have plans to return for a visit at some stage.
