Ashcroft v Iqbal, and it is kicking my ass.  For starters, the Supreme Court never says something with 10 words that it can say with 300.  Background for this case requires an intimate understanding of Bivens v 6 Unnamed Federal Agents and Bell Atlantic v Twombly and how these rulings affect Rule 8(a)(1) and 12(b)(6), moving to a "flexible plausibility standard" which obliges a pleader to amplify a claim with some factual allegations in those contexts where such amplification is needed to render the claim plausible.  Frankly, I think that this is a little much for opening the second week, especially as Ashcroft is only from 2008 and turns many years of jurisprudence on it's head.  A little chronological order would be appreciated here  :zombiefuck:

I know you Brits are on the Common Law system, how about you Scandinavians?  Common Law or Civil?

AFAIK the majority of the united states and Great Britain are on Common Law.  Louisiana uses Napoleonic law which is quite similar to what the rest of the world uses.  It's quite handy since Louisiana lawyers get to go to lots of exotic cities like Paris, Hong Kong, etc. rather than Philidelphia, Tucson, etc. for seminars.

Yes, Louisiana has come up several times in discussions so far for being the only state that pretends to be operating under Civil Law, though most of their civil laws are just codified versions of the Common Law.  Something about swamp gases ;)

Drinking some flavoured single vodka shots, and got a bottle of strawberry cream tequila liqueur which isn't bad.

Trying to remember the address of a website that I can get some decent quality 3-methoxy-PCP from. Although its far pricier than the 4-MeO substitution pattern, I prefer it.


Currently....posting here, reading the vespiary (clan chem forum), blacklight (far more advanced forum, thats SORT-OF like that...ish, but not quite, more of a hobbyists and interested people in general's neuropharmacology, biology, computational chem [I.e in silico receptor modelling and suchlike], medicine, and suchalike focus areas, with a general bent towards psychotropics and cognitive enhancers/nootropic agents)

Playing nethack, running a ground up oxycontin through a micron filter, after thats filtered and shot, going to have a rollup.

Gah, fucking hard to skin up with one hand partially paralysed (partly meaning 'mostly, but some slight movement remaining, along with the ability to grip between thumb and forefinger')

Although releasing my grip after is another thing entirely. Fucking frustrating.

Mmm..much better.Need to replace the synthetic skin graft type thing covering my arm. The wound is healing nicely though. The glue on the artificial skin though...sheesh. I find it irritating as hell. No amount of antihistamines will stop it itching like crazy. I think I'm going to leave it as it is for a little before I replace it with a new one, just for a breather so to speak.

And for that matter, numb it with a local. Drove me fucking batshit last night itching while I was trying to sleep. To say the very least, I was immensely grateful to my regular doc, and having a good supply of sleeping pills to hand. Not something I want to take all the time, for obvious reasons, but I like always to have them available, even if they aren't being used. At least then I have them in my bedside cabinet, rather than have some shitty nights THEN have to get up at 8am to get a chance of an appointment, and then catch a dr who isn't tight-fisted. At least now though, having had the rx for over a month, none of them CAN suddenly stop it without a benzo taper. Not needed, but they don't have to know I don't take my chlormethiazole every day, twice a day.

Not going to drink much at all tonight though, as I have a driving lesson tomorrow.
