No, Michael Shermer seems like he isn't going to take this to court because he'd have a hard time proving damages.

The story that I've heard is that this was a case of consensual sex where the woman involved was cheating on her boyfriend with Shermer. She regretted the affair years later and decided to tell Amanda Marcotte except she changed the story to one of an affair to a tale of rape. Amanda then passed the story to PZ.
