DETROIT, United States (AFP) - Philanderers beware: spouses caught cheating in Michigan could end up spending the rest of their life in prison.

And not the emotional kind.

The state's appeals court recently ruled that extramarital flings can be prosecuted as first-degree criminal sexual conduct, a felony punishable by up to life in jail.

"We cannot help but question whether the Legislature actually intended the result we reach here today," Judge William Murphy wrote in a unanimous Court of Appeals panel, "but we are curtailed by the language of the statute from reaching any other conclusion."

"Technically," he added, "any time a person engages in sexual penetration in an adulterous relationship, he or she is guilty of CSC I," the most serious sexual assault charge in the state's criminal code.

Michigan still lists adultery as a felony, although no one has been convicted of the offense since 1971.

Nobody really expects prosecutors to go after cheating spouses. But the ruling has the local legal community twittering about its genuine intended target.

One theory floating around the courthouse is that the judges were taking a jab at the state Supreme Court, which has decreed that judges must interpret statutory language adopted by the Legislature literally, whatever the consequences.

Many other states allow judges to reject a literal interpretation if they believe it would lead to an absurd result.

Judge Murphy wrote that he encouraged "the Legislature to take a second look at the statutory language if they are troubled by our ruling."

Totally absurd. Cheating is bad, but no-one deserves lifetime in prison for it.

That thing with literary interpreting the law whatever the consequenses isn't a specific Michigan or US thing, though. Swedish courts usually do the same or they verdict "according to practice", that is, when a new law comes up, the first verdict where the new law is used sets the standard for all similar cases, no matter the circumstances. That has consequenses like for instance, that a person who kills a wolf to protect his cattle will usually get a harder punishment than someone beating up another human being. A wolf may only be shot if it's attacking cattle, not if it has done it 10 times before and just sneaks around the fence... ::)

i remember staring this kinda tongue in cheek.  but i have been considering this all day long.
remember i have two daughters.  and i am frightened about their teenaged years.  especially because there are the playboy type of guys out there, like me.

i would be open minded about this tactic.  since sex is an issue that you cannot ignore.

Our sex ed was of the "This is a penis, this a vagina, this is a condom and this is an STD.  Any questions?  No?  Good." sort.  I think we got about 90 minutes of it during the whole of school, at the 14-15 age.

I was in a residential treatment center during adolescence, and those girls fucked like bunnies in their non-institutionalized lives, so the sex ed was pretty extensive.  I don't think anyone even bothered saying "don't" more than a couple times.  Basically, it was "USE PROTECTION.  FOR THE LOVE OF GOD, USE PROTECTION."  The public schools I was in offered sex ed in varying degrees from third grade till that point, mostly on what to do when you got your period.  Very useful to me, of course.   ;)

That's disgusting, show you just how bored lawmakers are these days. The problem is even if the law system hypothetically was perfect at some point (strictly hypothetical) they're paid their wages to fix it till its broke and I think laws like this are just going to show how bad things are getting. Yeah, I can see cheating pretty much being instant win for other spouse in divorce court and I'd almost be dickish enough to say that the partner caught cheating has to pay alimony even if its a woman who cheated on the guy. As for ranking it up with rape, pedophilia, or whatever is up there that's not a clever or innovative solution (such as what I suggested before) - its a farce.

There used to be a law against sodomy in Georgia that outlawed, among other things, oral sex, even between a married couple.  It was repealed.  I think there is hope that this one will be repealed too.

That's fine, as long as the person to whom you are married agrees with this and has the same inalienable biological banging rights that you do.  It would be wrong if it were one-sided or if she did not know ahead of time that you have these expectations of banging other people while you are married.  Many people assume that marriage implies monogamy, but if both people agree that it won't then it can mean whatever they agree that it means.  You may have difficulty finding a woman who shares your views, especially if you expect inalienable biological banging rights while denying her the same rights.
