Title: Got arrested yesterday!

Some asshole followed me into a parking lot and started yelling obscenities at me and saying he was kick to my ass. I got of my car and walked out of my way to avoid him and he continued. I started to yell back over my shoulder, continuing to walk away and into the store and he pulled out in his can to get parallel with me again and kept threatening. I yelled to "Fuck off and leave me alone!" ad continued to walk towards the entrance of the store. All of a sudden a cop car pulls up, nearly hitting me in the crosswalk and a cop gets out and steps in front of me, telling me to hold it right there. The other guy takes off in his van, but was chased down by the cop still in the car. I was charged with "Curse and Abuse" a Class 3 Misdemeanor.

It's bullshit as I tried to avoid the guy and hi threats and never stopped walking away. Just because I finally had enough and yelled back at him, I had to get arrested and now must go to court. I could lose my clearance and thus my job.

Have you talked to a lawyer yet?  You definitely need a lawyer because although this is bullshit that you got arrested, if you could lose your clearance over a  misdemeanor conviction, you need all the help you can get.

You did the right thing avoiding a fight only to be charged with this.  I hope they charged the other guy with fight on top of what you got. Time to move back north

I don't know what to say except, WTF?  I don't really understand not being able to curse in public.  Isn't there freedom of speech or something like that in our Constitution (being facetious now)? 

Definitely get some legal advice and hopefully you can get it quashed before trial.

The ACLU doesn't usually (if ever) get involved in cases outside the US, and I can't imagine their being a "Curse and abuse" law on the books anywhere in the US.

The right to tell someone to fuck off is one of the founding principals of the USA and is protected by the constitution.

The right to kick someone's ass isn't protected, but that wouldn't stop me if I were in that situation.

Surely once you see a lawyer Trigger and tell them that you were being abused by someone driving past and were scared (tell them you were shit scared, regardless of whether you were or weren't), you will be fine.

I tend to look at both sides here:

Trigger11 is a self-confessed anal-retentive, so his over-morality and over-adherence to speed limits etc. WILL piss off a fair few people. Even though the guy giving abuse may be an arsehole, it was most likely caused by trigger11's urge to drive slow.

Policemen are usually bored fuckers, especially if they're in a quiet spot. Just because they've the power of authority does not mean they're instantly true and just. As they are human, they are suspectible to the same human nature as the rest of us. This guy making up bullshit as an excuse to arrest is an example of that.

Adherence to speed limits doesn't mean that people deserve to be abused. And the limits in a car park are understandable, given that small children and pedestrians are in the vicinity.

I think you are assuming a lot about what led to the altercation. And if Trigger was driving at the limit and someone got pissed off....WTF does that have to do with AS? As you say 'his awkward Aspie manner of abiding laws'....ah, I don't think it's just people with AS who abide laws.

I just don't see your point in calling out someone as having awkward AS traits because they abide by the law. I think most people are expected to abide by the law.

Well, they were hardly flying before they got to the carpark. Maybe they were sailing? Or walking with cars attached to them? That isn't heresay that they were driving on the road first, that's common sense.

Also, there's a major difference between law abiding and "awkward Aspie manner of abiding laws". The former can do it without pissing many people off. The latter takes the laws literally and awkwardly abides them, causing more harm than good. For example, going 20mph on a 60mph motorway because they see that as a sure fire way to not get in trouble. Another example would be to not download stuff off torrent websites because they see it as "strictly against the law", even though it's extremely hard to enforce piracy laws online.

I'm sure Trigger will explain, so we will see if my assumption that it was caused by his slow driving is correct. As for links, look them up yourself.

Maybe he just got fired. Maybe his old lady is cheating on him. Maybe he had a bad hemorrhoid. Stalking and threats of violence have no excuse. Trigger's first action to protect himself from his own charges should be to press charges against his creepy offender.

Yes, but what would *trigger* him to go like that towards Trigger? Trigger must have been doing something to make him snap. This is why I believe it's the cause of Trigger driving slowly.

Actually, staring at someone will usually do that. People usually don't lash out at someone unless provocation occurred, even in the smallest way. It could be as simple as looking at the person and making eye contact. Besides I doubt someone will threaten to kick your ass if your smile reminds them of something negative; usually they'll tell you to fuck off, provoke you or throw a tirade of insults at you until you leave. Of course, this doesn't apply if you're dealing with a psychopath, as anything could set them off.

Yes, but both were driving before it happened. There could be countless reasons on why the guy was pissed off (might be late for something etc.), but ultimately it was triggered by something. That something could be Trigger's driving. If the guy was late for something important and Trigger's need to drive slow made him miss it, that could have caused him to follow him to the car park and give threats. There was no word if Trigger knew the guy before or anything.

If it was the case that the person is a psycopath, then I don't know. But it seems unlikely in this case.

Everything has a chain of events leading up to it from the beginning of time. Blame the big bang, or God, whichever preferred. Morality and philosophy don't always mix well. Then, maybe blame isn't the point being made, and separate discussions was a correct guess.

Re:  Trigger's slow driving-  I agree that slow drivers are irritating as fuck to some drivers, but that's not an excuse for speed demons to verbally or physically assault them.  If you're stuck behind someone who's driving too slowly, suck it up, or swear at them from inside your car with the windows rolled up.  Going beyond that is pretty much retarded and pointless, and will make you even later than you already are, if you are.

As a side note, I usually don't assume that slow drivers are adhering to the law because thye're interpreting it too literally.  I usually check for gray hair, and if that isn't present, assume they're probably drunk and/or high and don't want to get pulled over because they know they'll be in deep shit if they are.   :laugh:

Well, as an update, I went to court and asked if I could sit outside the courtroom, because you aren't allowed to wear hats and sunglasses and my light sensitivity just exacerbates my anxiety, as any of my sensory issues would. They complied and took my name down and said they would come get me when it was my time. Almost 7 hours later, I went back in and at a recess I asked if they were going to call me. Apparently they forgot I was outside and I was found guilty in absentia. The other bailiff was cool and went back to talk to the judge, so when the recess was over he called me up and we talked about the issue. He couldn't judge on the charges because the deputy was long gone, so he gave me a continuance until 29 September 2010.

To summarize, it was cool they were understanding of my issues, but then again they forgot all about me and I sat there all day with no sense of time because I left my phone in my car and there was no clock. Well, as an update, I went to court and asked if I could sit outside the courtroom, because you aren't allowed to wear hats and sunglasses and my light sensitivity just exacerbates my anxiety, as any of my sensory issues would. They complied and took my name down and said they would come get me when it was my time. Almost 7 hours later, I went back in and at a recess I asked if they were going to call me. Apparently they forgot I was outside and I was found guilty in absentia. The other bailiff was cool and went back to talk to the judge, so when the recess was over he called me up and we talked about the issue. He couldn't judge on the charges because the deputy was long gone, so he gave me a continuance until 29 September 2010.

To summarize, it was cool they were understanding of my issues, but then again they forgot all about me and I sat there all day with no sense of time because I left my phone in my car and there was no clock. I literally sat on a hard bench and never got up the whole time. Ultimately, the judge seems to be pretty reasonable, so I am confident when I return that I can reason with him. I have a clean record, so I am not a menace to society...yet! ;p

Seems like a stupid waste of everybody's time.

I'm sure your constant need to drive at 10mph pissed him off.

I actually have a bit of a lead foot and speed, but not excessively, on highways and interstates. I do, however, take 35 mph and less zones very literally as they are so low for the reasons of pedestrians and, more importantly, kids.

To more thoroughly explain what happened, I cam around a bend and was in the merge lane. He was on the road I was merging onto, and he had the right of way. I came around the bend at the speed limit of 45 mph and found myself dead even with him. I had a car in front of, who merged in front of this guy, and a car behind me, whom I lost sight of coming around the bend. I could not speed up to merge in front of him, as there was not enough acceleration lane to do so and it would have been dick of me anyway. I couldn't do a hard slowdown to get behind him, because of that car behind me. I had a couple of seconds of lane left at that speed and put my car in neutral and naturally slowed down to let the guy get ahead of me, but not screw the car behind me, who may or may not be trying to speed up for the merge. I merged behind the guy at the very end of the merge lane, with about five feet between us. I continued to slow down as I merged, so as to put distance between us and not be tailgating. As I did so, I realized the left lane was completely clear, so I put my signal on and safely merged into the left lane, where I could accelerate back up to the speed limit and passed the guy. As I passed him he flipped me off and said, "Fuck you asshole!" He then followed me into the parking lot, parked near me, and continued to yell at me, including the threats of kicking my ass.

I can only guess that he was set off by one or both of the following:

1) I came around the bend in the merge lane and was right alongside of him for a couple of seconds.

2) By slowly merging over at the end of the lane, I cut the distance close from my front end and his bumper.

As a physicist and mathematician, I calculated everything precisely in my mind to do as safe a merge as possible, given all of the variables. I still had to worry about the car behind me  that was momentarily out of my rearview mirror. I didn't have time to relocate that car, so I chose the easing off the gas and going into neutral method, rather than a quicker application of the brakes. You'd have to ask him, but he must have thought this was offensive in some way.

Thanks, but the Xanax XR deserves the credit. It was wearing down and after talking to the bailiff, but before getting to talk to the judge, I sat down and put my head down and cried. I did get my composure back, though. That was a long and tiring day emotionally and physically, and now I have to do it again. Yay! :thumbdn:

Maybe since they made the exception to sit outside the first time, they will just allow the sunglasses inside the second. A pair of wire frame sunglasses with small lenses would look just like regluar glasses but dark, and maybe acceptable.

I wear Irlen lenses and they are dark enough so that when I had my driver's licence photo taken, I had to take them off. Same for my uni ID. I wonder what would happen if I had to go to court. I can't see very well without my glasses and I don't have clear lenses.

Because of the nature of my job, I had to report the incident, so I reported it to my department security representative, but I left it very generic. He asked for more information, but I didn't respond...partially due to my conflict avoidance and partially due to my belief that sharing personal information at work has been nothing but detrimental to my career, if you can call it that, and will only be used against me. So yesterday I get an e-mail from Division Head, who is my supervisor's boss and the one who has made it clear she wants me gone and I will not be promoted, given a raise, or anything as long as she is on that position, asking me for more details. The problem is, she should not have known about this. The security representative had no right to share this information with management. Now she has more ammo against me in her quest to get me fired. Today, I went to HR and discussed the implications and meet later this week with the counselor to determine if I should file a formal grievance or not. I also went down to our Command's security office and officially reported the incident to them, bypassing my department. They said this will not affect my clearance. Worst case, when my clearance comes up for review, I might get interviewed again to clarify what happened. But that will only happen if convicted and I am anticipating this getting thrown out.

GUILTY! :finger:

Had to pay a $25 fine, which was good considering it was up to $500. Still leaves a bad taste in my mouth and is confusing. When asked to raise my hand I pointed out I couldn't do the whole deity thing and I was allowed to 'affirm' I would tell the truth. Don't want to go to work though now. Mind is racing.

I'm going to look into it with the ACLU, but if you look it up online the courts generally won't take cases involving stuff like this. In CA you can wear a shirt that says fuck the courts or whatever, but in podunk VA you can't even say, "Fuck Off!"

I am sorry to hear that. I'm glad the fine was only $25, but how the hell do they expect people to defend themselves against aggression,

Nope! I am now a common criminal according to the state of VA!

I'd love to not live in the 'south' but have three kids I ain't leaving. Plus, VA is supposed to be more inline with more moderate states and is really part of the mid-Atlantic, sans the southwestern part of the state. Due to the government and more specifically the military, the state is filled with people from the northeast and midwest.

you know what that reminds me. when i was at the arizona cardinals training camp a few years ago

after it was a hard thing to do to get emmit smiths autograph, outside a security guard almost called the cops because i was using foul language about how hard it was to get his auto.

doesnt suprise me. cops want to get you for anything

yep. a few years ago a security guard almost 'citizen' arrested me because i was displeased about how emmit smith wasnt signing autographs, of course i was using the F word and N word discribing my discust :zoinks:

i think the guy thought i was going to get physical with the star athlete. wich is hilarious, because im very non violent

Holy crap! On my way home from work, some bitch pulls out from the light we were stopped at and all of sudden slows down and almost stops, even though the speed limit is 45 mph and turns to 55 mph in less than 100 feet. I was several car lengths behind her when she started to slow down. Naturally I got closer to her as she slowed and then she started to pump her brakes in front of me real hard. At this point I am about 10 feet behind her and she finally slides into the left turn lane. Not: She did not use a proper turn signal, giving no indication as to what her intent was. As I then accelerated past her, she screams out, "Fuck you, asshole!"

ARE YOU FUCKING KIDDING ME??!!??!!??

I just proceeded on even though two thoughts were prevalent in my head. One was to pull over and punch her in the face. But I am a pacifist and would never hit someone else. The other thought was to politely pull over, turn the recorder on on my iPhone, and get her to go on to a tirade of profanity and call the cops and have her arrested.

WHAT IS FUCKING WRONG WITH PEOPLE??!!??!!??

I have a Velcro mount for a camera on my dash for these things  I just push a button and there is the evidence just opps hit her then turn in the tape

It's been 8 years.  As long as you have no more arrests, you may be able to have it expunged.
